These Terms & Conditions form a binding agreement between you and Pixeldvx Design, a sole proprietorship registered in Ontario, Canada, operator of the “Sir Balone” brand (“Sir Balone”, “we” or “the Company”). Please read them carefully before using our services.

01Acceptance of terms

The mere act of entering your email address, requesting an access link (“magic link”) and reaching an authenticated session in La Lente completes the agreement and constitutes your full acceptance of these Terms, the Privacy Policy and the Refund Policy. If you do not agree with any part, you must not use the service.

You represent that you are at least 18 years old, or the age of majority in your jurisdiction, and have the capacity to enter into binding contracts.

02The service and usage limits

Sir Balone offers La Lente, an automated football-performance analysis tool powered by algorithms and artificial intelligence, whose proprietary metric is the VNP (Net Production Value). The service is provided solely as online digital content and results; no tangible medium is delivered and no licence is granted to install or copy the underlying software.

Access is conditional on payment of a membership or package and subject to operational limits imposed by the platform architecture:

• Recurring membership: grants continued access with a daily usage limit described as a fair-use policy intended to prevent server saturation.
• Prepaid usage packages: grant a set number of queries. Unless stated otherwise at the point of purchase, purchased credits may be subject to an expiration date, which will be specified at the time of the transaction.

We reserve the right to modify, suspend or discontinue features of the service and to adjust usage limits to preserve platform stability.

03Payment processing and reseller (Merchant of Record)

The payment process, tax calculation and processing, and financial fulfilment of your order are performed and managed entirely by our online reseller and Merchant of Record, Paddle.com. By processing a transaction for this platform’s subscription or analytical packages, you independently agree to be bound by Paddle’s Buyer Terms and its privacy policy.

Paddle acts as the authorised reseller of the digital product and assumes responsibility before tax authorities for the collection and remittance of sales taxes (VAT, GST and equivalents) in the buyer’s jurisdiction. During checkout, the Paddle window will display its own terms and privacy policy; depending on your location, the transaction may be carried out by Paddle.com Market Limited or another of its affiliates.

04Access, authentication and magic links

The platform uses a passwordless sign-in mechanism based on a single-use, time-limited link (“magic link”) that relies on the user’s email provider infrastructure.

You are solely and exclusively responsible for maintaining the security of your inbox. To the maximum extent permitted by law, the Company is released from any liability arising from unauthorised access to your account or platform credits where such access results from email interception, compromise of your email account, phishing attacks, or sharing the link or tokens derived from it. You must not forward your access link to third parties.

05Third-party data and acceptable-use rules

Sports-performance data is obtained under a legitimate commercial licence from Sportmonks. To protect that licence and the intellectual-property rights involved, when using the service you agree not to:

• use robots, spiders, scrapers or any other automated means to extract, copy or harvest the statistical data displayed in the interface;
• remove, obscure or alter proprietary notices, trademarks or copyright of the Company or its data providers;
• resell, redistribute or commercialise the raw data or the AI outputs as if they were your own data feed;
• reverse-engineer the VNP metric or the algorithmic models, or use the service to build a competing product.

The application provides transformative value (analysis, advanced metrics and projections); it is not, and may not be used as, a conduit for reselling raw data.

06Sports and warranty disclaimer

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose or accuracy of results. We do not guarantee any sporting outcome, projection accuracy, model output or financial result derived from use of the tool.

07Store (La Galleria) and newsletter (Le Note)

The La Galleria store offers limited-edition illustrations and physical products. The sale, payment and shipping of these products are handled by our partner Fourthwall, acting as merchant of record for those transactions; Fourthwall’s terms and refund policy apply to them, as detailed in our Refund Policy.

The Le Note newsletter is distributed through Beehiiv and requires your express opt-in consent. You may unsubscribe at any time via the link included in each email. See the Privacy Policy for details.

08Suspension and cancellation

You have the right to cancel future renewals of your subscription at any time, clearly, directly and without penalty, from your account panel. Cancellation stops recurring charges going forward; it does not by itself trigger a refund of periods or uses already provided (see the Refund Policy). This mechanism complies with Ontario’s Consumer Protection Act and the withdrawal-button requirement of EU Directive 2023/2673.

We may suspend or terminate your access, with or without notice, if you breach these Terms, use the service fraudulently or abusively, or where the law requires it.

09Intellectual property

All Sir Balone content — including the software, the VNP metric, the Le Note editorial texts, the La Galleria illustrations, logos, trademarks and design elements — is owned by the Company or its licensors and protected by Canadian and international copyright and trademark law. You are granted no rights over them beyond the personal, non-commercial use expressly authorised by these Terms.

10Limitation of liability

To the maximum extent permitted by applicable law, the Company’s total aggregate liability to you for any claim relating to the service is limited to the total fees you paid in the twelve (12) months preceding the event giving rise to the claim. The Company shall not be liable for indirect, incidental, special, punitive or consequential damages, nor for lost profits or data loss.

11Changes to the terms

We may update these Terms at any time. The version in force will always be the one published on this page, with its update date. Material changes affecting your rights will be notified by reasonable means. Continued use of the service after changes are published constitutes acceptance.

12Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Any dispute shall be submitted to the competent courts of Ontario, without prejudice to any mandatory consumer-protection rights granted to you by the law of your country of residence.
